Welcome to belveracircle. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Customer", "you") and the sole trader operating belveracircle.shop under the trade name belveracircle ("we", "us", "our"). By accessing, browsing, registering on, or making a purchase through the Website, you confirm that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, all of which are incorporated by reference. If you do not agree with any portion of these Terms, please refrain from using the Website.

These Terms are published in accordance with applicable laws of the United Kingdom, including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Protection from Unfair Trading Regulations 2008, the Electronic Commerce (EC Directive) Regulations 2002, the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018. Nothing in these Terms affects your statutory rights as a consumer.

  • All information you provide is true, accurate, current, and complete.

3. Modifications to the Terms

We reserve the right, at our sole discretion, to modify, amend, add to, or remove any portion of these Terms at any time. Any changes will become effective upon being posted on the Website and will not apply retrospectively to orders already placed. It is your responsibility to review this page periodically. Your continued use of the Website following the posting of any modifications constitutes your binding acceptance of the revised Terms.

4. User Accounts

You may need to create an account to place an order or access certain features. By registering, you agree to:

  • Provide accurate, current, and complete information, including full name, shipping address within the United Kingdom, email, and phone number;
  • Maintain the confidentiality of your login credentials and accept full responsibility for all activities under your account;
  • Refrain from creating multiple accounts for the same individual or transferring your account to any third party;
  • Notify us immediately at [email protected] if you become aware of any unauthorised use of your account.

We reserve the right to refuse service, suspend or terminate accounts, cancel orders, and remove content at our sole discretion, particularly where we reasonably believe a violation of these Terms has occurred or where fraudulent activity is suspected.

5. Products and Orders

We sell a range of products listed on the Website. The following terms apply to all listings and orders:

  • Product Descriptions: We make every effort to display product details accurately. However, slight variations in colour, finish, material, or fit may occur due to lighting, screen calibration, and manufacturing tolerances.
  • Country of Origin: The country of origin and country of manufacture for each product is disclosed on the relevant product page, in accordance with the Consumer Rights Act 2015 and the Consumer Protection from Unfair Trading Regulations 2008.
  • Availability: All orders are subject to product availability. We reserve the right to limit quantities, refuse, or cancel any order at our sole discretion, including in the event of stock shortages, pricing errors, or suspected fraudulent transactions.
  • Order Confirmation: An order confirmation email or message is an acknowledgement only and does not constitute final acceptance of your order. A binding contract is formed only when we dispatch your order. We reserve the right to verify, approve, or decline any order before processing.

6. Pricing, Taxes, and Payment

  • Free Shipping: We offer free shipping on all orders delivered within the United Kingdom. No shipping or handling charges will be added at checkout.
  • Payment Methods: We accept payment through secure third-party payment gateways, including credit and debit cards and approved digital wallets (e.g., PayPal, Apple Pay, Google Pay). We do not store complete payment card information on our servers.
  • Failed Transactions: If a payment is debited but the order is not confirmed, the amount will be refunded to the original payment method within 7–10 working days.

7. Shipping and Delivery (United Kingdom Only)

We currently provide shipping services exclusively within the territory of the United Kingdom. We do not accept or fulfil international orders. Orders placed with a shipping address outside the United Kingdom will be cancelled and refunded.

  • Free Shipping on All Orders: We provide complimentary free shipping on every order across the United Kingdom, with no minimum order value required. No shipping fees, handling charges, or hidden costs will be applied at checkout.
  • Order Processing Time: Orders are processed and dispatched within 1–2 working days from the date of successful order confirmation and payment.
  • Delivery Time: Standard delivery within the United Kingdom typically takes 3–5 working days after dispatch, depending on the destination postcode and courier partner.
  • Total Estimated Timeline: Customers can expect to receive their orders within approximately 4–7 working days from order placement, subject to courier availability, weather conditions, and unforeseen logistical delays.
  • Serviceable Areas: We deliver to most postcodes across the United Kingdom through our courier partners. In rare cases, certain remote locations may not be serviceable; in such situations, we will notify you and process a full refund.
  • Risk and Title: Risk of loss in the goods remains with us until they are delivered to you at the address you provided, at which point risk and title pass to you.

Detailed shipping terms, courier partners, and tracking information are available in our separate Shipping Policy.

8. Cancellation, Return, Refund, and Exchange

Detailed terms relating to order cancellation, returns, refunds, exchanges, and warranty for products are governed by our separate Return & Refund Policy, which is incorporated by reference into these Terms. Key highlights:

  • Cancellation: Orders may be cancelled before they are dispatched (i.e., within the 1–2 day processing window). This is in addition to your statutory right to cancel within 14 days under the Consumer Contracts Regulations 2013.
  • Return Window: You may return eligible products within 14 days of delivery for any reason, in line with the Consumer Contracts Regulations 2013. Faulty, misdescribed, or not-fit-for-purpose goods may be rejected within 30 days for a full refund under the Consumer Rights Act 2015.
  • Made-to-Order/Custom Products: Made-to-order, custom-configured, or personalised products are produced to your specifications and may be exempt from the standard cancellation right, except in cases of manufacturing defect or incorrect processing on our part.
  • Refund Timeline: Approved refunds are processed within 7–10 working days to the original payment method, and in any event within 14 days of our receiving the returned goods, in line with the Consumer Contracts Regulations 2013.

9. Made-to-Order & Customised Products

For made-to-order or customised products, you are solely responsible for providing accurate, current, and complete specifications. belveracircle shall not be liable for any issues arising from incorrect, outdated, or incomplete information submitted by the customer. We strongly recommend reviewing your specifications carefully before placing an order. All custom products are produced in compliance with applicable UK regulatory and product-safety standards.

10. Intellectual Property Rights

Unauthorised use may result in legal action under the Copyright, Designs and Patents Act 1988, the Trade Marks Act 1994, and other applicable statutes.

11. Prohibited Conduct

You agree not to host, display, upload, modify, publish, transmit, store, update, or share any information, or use the Website in any way, that:

  • Belongs to another person and to which you do not have any right;
  • Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, harassing, or discriminatory on the basis of any characteristic protected under the Equality Act 2010, or is otherwise unlawful;
  • Is harmful to children;
  • Infringes any patent, trademark, copyright, design right, or other proprietary right;
  • Violates any applicable law;
  • Deceives or misleads any person about the origin of a message, or knowingly communicates any false or grossly offensive information;

  • Promotes or incites terrorism, violence, or any criminal offence, or threatens public safety or national security;
  • Otherwise interferes with the operation, security, or integrity of the Website.

12. Disclaimer of Warranties

Subject to the paragraph below, the Website and all content and materials offered through it are provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Website will operate uninterrupted, error-free, or be free from viruses; that all information provided is complete, accurate, or current; or that products will meet every individual customer's specific requirements where information provided by the customer (such as measurements or specifications) is inaccurate.

We are not responsible for discomfort or dissatisfaction caused by inaccurate measurements or specifications supplied by the customer, or issues arising from misuse of the product. Nothing in these Terms excludes or limits your statutory rights as a consumer under the Consumer Rights Act 2015 (including that goods must be of satisfactory quality, fit for purpose, and as described), nor our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, belveracircle, its affiliates, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, or consequential loss — including without limitation loss of profits, loss of goodwill, loss of data, or business interruption — arising out of or in connection with your use of, or inability to use, the Website or the products purchased through it. Our aggregate liability for any claim arising out of or relating to these Terms shall not exceed the total amount actually paid by you for the specific order that is the subject of the claim. Nothing in this clause limits or excludes any liability that cannot be limited or excluded under UK law, including your statutory rights as a consumer and our liability for death or personal injury caused by negligence or for fraud.

14. Third-Party Links and Services

The Website may contain links to third-party websites, services, or resources that are not owned, operated, or controlled by us. We do not endorse and are not responsible for the content, policies, products, or practices of any third-party website or service. Accessing third-party links is done at your sole risk; you are encouraged to review the terms and privacy policies of those third parties.

15. Indemnification

You agree to defend, indemnify, and hold harmless belveracircle, its affiliates, agents, licensors, and suppliers from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or connected with: (i) your use or misuse of the Website or products; (ii) your breach of these Terms or any applicable law; (iii) any inaccurate or fraudulent information you provide, including incorrect specifications or measurements; or (iv) your violation of any third-party rights. This clause does not apply to the extent any loss results from our own breach, negligence, or wrongdoing.

16. Termination

These Terms remain in effect as long as you use the Website. Either party may terminate this Agreement at any time. belveracircle reserves the right, in its sole discretion and without prior notice, to suspend or terminate your access to the Website, cancel pending orders, and remove content you have posted, if we reasonably believe you have violated these Terms or any applicable law. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnity, and limitations of liability) shall remain in effect. Termination does not affect any order already accepted or your statutory rights in relation to it.

17. Force Majeure

We shall not be held liable for any failure or delay in performance under these Terms resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, civil unrest, fire, floods, severe weather, pandemics, epidemics, government actions, network or courier failures, strikes, industrial action, or shortages of transportation, fuel, energy, labour, or materials.

18. Electronic Communications and Consent

By creating an account or placing an order, you consent to receive electronic communications from us — including emails, SMS, and (where you have provided the relevant contact details) messaging-app notifications — regarding your account, orders, transactions, and customer support. These electronic communications satisfy any legal requirement that such communications be in writing. We will only send you marketing communications where you have given consent, or where the "soft opt-in" for existing customers under the Privacy and Electronic Communications Regulations 2003 (PECR) applies. You may withdraw consent for marketing communications at any time by following the unsubscribe instructions or contacting us at [email protected].

19. Privacy and Data Protection

Your personal information is collected, processed, stored, and disclosed in accordance with our Privacy Policy, the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018. By using the Website, you acknowledge that your personal data will be handled as described in our Privacy Policy.

20. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website; however, if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home jurisdiction. Before initiating legal proceedings, the parties shall attempt to resolve disputes amicably through good-faith negotiation, and where appropriate, through the complaints and dispute-resolution mechanism set forth in Section 24 below.

21. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to any successor entity or third party, including in the event of a sale of business, merger, or restructuring, provided this does not adversely affect your rights under these Terms.

22. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return & Refund Policy, and any other legal notices published on the Website, constitute the entire agreement between you and regarding your use of the Website and supersede any prior agreements, communications, or understandings, whether written or oral. This clause does not exclude liability for fraud or fraudulent misrepresentation.
